FOREIGN OFFICE.

Sir:-

I am directed by the Marquess of Lansdowne to acknowledge receipt of your letter No.25395/1904 of the 27th. ultimo with regard to the exercise of the power of deportation conferred by the China and Japan Order-in-Council 1865.

I am to state, for the information of Mr. Secretary Lyttelton that a Consolidating Order-in-Council for China and Corea will shortly be passed in which the deportation clause is materially different from that now in force, and provides that the place to which a person shall be deported shall be a place in some part (if any) of His Majesty's Dominions to which the person belongs, or the Government of which consents to the reception of persons deported under the Order.

In these circumstances it is not necessary to issue any such instructions as those suggested in your letter
